Sunkara Privacy & Data Protection Policy

We at Sunkara Wellness Technologies, Inc. (“we”, “us,” “our”, respect your privacy and commit to protecting it through our compliance with the practices described in this notice.

This Privacy Notice describes our practices for collecting, using, maintaining, protecting, and disclosing the personal data we may collect from you or that you may provide when you use our website (www.sunkarawellness.com), mobile application, services, tools and features, or otherwise interact with us (collectively, the “Services”). For purposes of this Privacy Notice, “you” and “your” means you as the user of the Services, whether you are a customer, website visitor, job applicant, representative of a company with whom we do business, or another individual whose data we have collected pursuant to this Privacy Notice. 

Please read this Privacy Notice carefully to understand our policies and practices for processing and storing your personal data. By using any of the Services, you accept and consent to the collection, use and disclosure of your data as described in this Privacy Notice. If you do not agree to this Privacy Notice, please do not use or access the Services. This Privacy Notice may change from time to time (see Changes to Our Privacy). Your continued engagement with the Services after any such revisions indicates that you accept and consent to them, so please check this notice periodically for updates.

Data We May Collect About You

When you use or access the Services, we collect and use different types of data from you. Some features of the Services may require you to directly provide us with certain information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing these features. Information that you directly submit through our services includes:

  1. Information that we could reasonably use to directly or indirectly identify you, such as your name, email address, demographic information, and any other identifier we may use to contact you online or offline (”personal data”).

  2. Any information you choose to include in journal entries or any other communications with us (such as sending a message through the Services), which may contain personal and non-personal data.

If we combine or connect non-personal with personal data so that it directly or indirectly

identifies an individual, we treat the combined information as personal data.

How We Use Your Personal Data

We use your personal data to provide the Services, communicate with you, maintain and secure your account with us, or to conduct other business operations, such as using data to improve and personalize your experiences, and to better understand user interaction with the Services. Examples of how we may use the personal data we collect include to:

  1. Provide you with the Services.

  2. Fulfill the purposes for which you provided the data or that were described when it was collected.

  3. Notify you about changes to the Services.

  4. Conduct internal operations, including for troubleshooting, data analysis, testing, research, statistical, and survey purposes.

  5. Improve our app, products or services, marketing, or customer relationships and experiences.

We may use non-personal data for any business purpose.

 

In addition to the specific uses described above, we may use any of the above information as needed in complying with applicable legal obligations, enforcing any applicable terms of service, and protecting the Services, our rights, and the rights of our employees, users or other individuals.

Disclosure of Your Personal Data

We may disclose your personal data to third parties for legitimate purposes subject to this Privacy Notice, including the following categories of third parties:

  1. Any member of our corporate group, which means our subsidiaries, our ultimate holding company and its subsidiaries, and our affiliates.

  2. Vendors or other services providers who help us provide the Services, including for system administration, cloud storage, security, customer relationship management and web analytics.

  3. Professional advisors, such as auditors, law firms, or accounting firms.

  4. To fulfill the purpose for which you provide it.

  5. With your consent.

We may also disclose your personal data to third parties:

  1. ​In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.

  2. To a buyer or other successor in the event of merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, where one of the transferred assets is the personal data we hold.

  3. To comply with any court order, law, or legal process, including responding to any government or regulatory request.

  4. To protect the rights, property, or safety of our business, our employees, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of cybersecurity, fraud protection, and credit risk reduction.

We may share non-personal data without restriction.‌

Consent to Personal Data Transfer

We are based in the United States. We may process, store, and transfer the personal data we collect, in and to a country outside your own, with different privacy laws that may or may not be as comprehensive as your own, including the United States.

By submitting your personal data or engaging with our app, you consent to this transfer, storing, or processing.

Accessing and Correcting Your Personal Data

You may send us an email at info@sunkarawellness.com to request access to, correct, or delete personal data that you have provided to us. We cannot delete your personal data except by also deleting your user account. We may not accommodate a request to change or delete information if we believe the change or deletion would violate any law or legal requirement or negatively impact the information’s accuracy.

Data Security

Despite our reasonable efforts to protect your information, no security measures are impenetrable, and we cannot guarantee “perfect security.” Any information you send to us electronically, while using the Services or otherwise interacting with us, may not be secure while in transit. We recommend that you do not use insecure channels to send us sensitive or confidential information. 

 

We retain your information for as long as is reasonably necessary for the purposes specified in this Privacy Notice. When determining the length of time to retain your information, we consider various criteria, including whether we need the information to continue to provide you the Services, resolve a dispute, prevent harm, promote safety, or protect ourselves, including our rights, property or products.

Children’s Online Privacy

We do not direct our app to minors and we do not knowingly collect personal data from children under 16. If we learn we have mistakenly or unintentionally collected or received personal data from a child without appropriate consent, we will delete it. If you believe we mistakenly or unintentionally collected any information from or about a child, please contact us at info@sunkarawellness.com.

Changes to Our Privacy Notice

We may modify this Privacy Notice from time to time, in which case we will update the “Last Updated” date at the top of this Privacy Notice. If the changes materially alter how we use or disclose your personal data, we will use reasonable efforts to notify you (such as by emailing you at the primary email address specified in your account, posting notice of such changes of the Services, or by other means consistent with applicable law).  If you do not agree to any updates to this Privacy Notice, please do not continue using or accessing the Services.
